Legal representation at Mediation, in the Employment Relations Authority and Courts

We provide expert assistance and representation to assist you to navigate employment law disputes.  This includes advice on day-to-day employment matters, to assistance resolving complex issues in a thorough, timely and effective manner.  At times, this may require early dispute resolution or attendance in the Employment Relations Authority or the Courts.

Mary has experience in a wide range of complex disputes, such as personal grievances claims, restructures, status law (employee or contractor and controlling third party relationships), health and safety and stress related issues, bullying and harassment, parental leave and protection, restraint of trade and protection of confidential information. 

Mary regularly attends mediations and has acted in the Employment Relations Authority, Employment Court, District Court, High Court and Court of Appeal.

Privacy

Failure to comply with the Privacy Act 2020 may have serious ramifications for both employers and employees.

Mary has the experience and knowledge to advise you on Privacy Act 2020 compliance, or to assist you to navigate a privacy claim.  

This may involve representation in dealings with the complainant, the Office of the Privacy Commissioner, the Human Rights Commission | Te Kāhui Tika Tangata, at mediation or the Human Rights Review Tribunal.

Human Rights

Human rights are fundamental protections guaranteed under the Human Rights Act 1993.

As such, claims of unlawful discrimination, if not managed appropriately, could cause significant reputational damage and cost.

Mary has provided representation at mediation and in the Human Rights Review Tribunal in respect of discrimination, sexual harassment, and privacy claims.

Investigations

The appointment of an independent investigator to investigate allegations of misconduct, serious misconduct, bullying or harassment, discrimination, clinical practice or medical incapacity is important to meet the test of justification under the Employment Relations Act 2000.

Mary’s practice covers instructions as independent counsel in investigations and workplace culture reviews. Mary has a wealth of experience investigating complex issues in a thorough, timely and effective manner.

Mary understands the importance of undertaking investigations in a fair, timely and discreet manner and meeting the procedural requirements under the Employment Relations Act 2000.
